Provision of Horse Training Terms of Services
Agreement to provide Services
1. A decision by Applied Equitation Solutions (Trainer) to offer their Services will involve a two part consultation. Part 1a will include an overview of Applied Equitation Solutions as well as an outline of experience, qualifications, terms of services fees & payment options. An assessment of the horse and handler/rider combination will be undertaken. No fee will be charged.
2. If the client and Trainer mutually agree to progress, the consultation will progress to Part 1b. Part 1b of the consultation will include the collection of personal information, followed by initial goal setting. A Quote will be provided at the end of Part 1b. The Quote will provide an outline of the services to be provided and an estimate of the cost for those services.
3. If the quote is accepted a formal agreement will be provided to the client. Normally feed and agistment costs will be due for payment no later than 7 days prior to the agreed start date of Services. Other costs described in the Quote will be due either on a fortnightly basis or at the end of Services provided; whichever is agreed between the client and the Trainer.
Refunds and cancellation of Services
4. Cancellation by the Trainer due to conditions such as, extreme wet weather, high temperatures, high winds and other similarly assessed conditions will result in either a full refund or an offer to reschedule the agreed Services.
5. If training is cancelled by the Client, more than 7 days prior to the agreed date for the commencement of Services, a full refund of any fees paid will be made.
6. If the client wishes to cancel the agreed services, less than 48 hours prior the scheduled date, a reduced refund [1] may be applicable. Rescheduling of services will be offered; however this will be at the discretion of the Trainer.
7. Cancellation of Services by the Trainer due to concerns over a horse’s health and welfare will see no refund.
Clients responsibilities
8. It is the client’s responsibility to ensure the health and welfare of their horse is at the required standard prior to commencing of the agreed Services.
9. It is suggested that the client provide tack and saddlery which the horse normally uses. If provided it will be the client’s responsibility to ensure that this tack and saddlery is serviceable and fit for purpose.
10. The client should consider obtaining an insurance solution to cover unforeseen events while the Horse is on agistment and in training.
Trainers responsibilities
11. The Trainer agrees to provide services [2] in accordance with Australian Consumer Law. In accordance with the implied guarantees relating to the provision of services, if a client is not satisfied with our services a refund of fees may be made. All services will be: delivered with acceptable care, skill or technical knowledge and taking all necessary steps in attempting to meet client goals, fit for the purpose or give the results that the client and the Trainer have agreed to, and delivered within a reasonable time when there is no agreed end date.
12. The Trainer agrees to provide normal and reasonable care to maintain the health and well-being of said horse. Care and services not normally provided are farrier services, dental care, veterinary services, de-worming or vaccination. A separate agreement will be needed if these services are required.
13. Training and horse management activities will be conducted in accordance with the First Training Principles presented by the International Society for Equitation Science and the responsible use of horses described under the Social Licence to Operate advocated by WorldHorseWelfare.

Payment
15. Payment for services will be via Direct Deposit or cash. An invoice for services can be provided on request.
Emergency care
16. If emergency treatment is needed, the Trainer will attempt to contact the client, but, in the event the client is not reached, the Trainer has the authority to secure emergency veterinary and/or farrier care. The client is responsible to pay all costs relating to this care.
17. The Trainer is authorised as the clients Agent to arrange billing to the client.
18. In the event the Trainer is unable to contact the client and must make a medical decision (ie, send the horse for surgery, euthanasia, etc), actions you (as the client) want the Trainer to take should be described in the Horse Information document (provided separately).
19. While the Horse is located at the Trainer’s, the Trainer shall not be liable for any injury, illness, death or theft suffered by the horse or any other cause of action arising from or connecting to the agistment of the Horse.
20. The client agrees to hold the Trainer harmless for any loss or injury to said horse. All costs, no matter how catastrophic, connected with agistment, training, or any other reason for which the horse is on the premises of the Trainer, are to be borne by the Client.
